Finally.... Our boy has landed! A nice sunny cubicle at FCI Coleman Low, located in Coleman, Florida. Junior was sentenced to another 30 months in<br />
Federal Prison yesterday afternoon, and was taken directly from the courtroom to jail. Judge Moon expressed his disgust with Coghill when he said "I give no credence to anything you have to say, Mr. Coghill. I see con men in here all the time, and they just keep conning and conning." (I'm paraphrasing here, will have the exact quote when I get the transcript of the hearing)<br />

The hearing opened with Assistant US Attorney Pat Hogeboom and Coghill's attorneys agreeing that they were satisfied with all of the terms of the plea agreement. Coghill was asked if understood the terms of the agreement, and he mustered up his most contrite self (which wasn't all that believable) to say that he understood the terms of the plea. Hogeboom then requested that Don Melcher be heard with a victim impact statement. I came forward, addressed the Court and said:<br />
<br />
Your Honor, in March of 2006 I was allowed to make a victim impact statement, and at the<br />
time I told the court that the theft of half million dollars caused a great<br />
deal of damage to my family. Imagine if your entire savings were gone in<br />
one day..... and that you still had obligations you could not just ignore<br />
or cancel. I had nowhere to turn, and as a result, my credit was ruined, my<br />
daughters were forced to change college plans... the student loans they<br />
had to take out will be not be paid off for many years. I was without<br />
insurance, without money to pay for many common necessities like dental<br />
care, and I was forced to rent living space because I had no money for a<br />
down payment and no credit for a home loan. Since that time, I have done<br />
some rebuilding, but the long term impact remains. Mr. Coghill did not care<br />
that he had stolen everything I had, and he does not care now. As the court<br />
has seen, he has shown no remorse and he continues to demonstrate that he<br />
will do whatever he wants to do, regardless of the Terms of Probation or<br />
Conditions of Release.<br />
<br />
When he was arraigned on six counts of fraud on January 17, 2005, he was<br />
told by the Court, and I quote, "not to enter into ANY additional financial<br />
obligations, either personal or business." What did he do? He went back<br />
to Florida and continued to engage in those same activities.<br />
<br />
When he plead guilty to two counts of fraud on August 17, 2005, he was again<br />
reminded by the Court that he was to refrain from involvement in any real<br />
estate transactions. What did do? He told the Court "yes sir" and went<br />
right back to Florida and continued to be involved in real estate<br />
transactions.<br />
<br />
When he was sentenced for two counts of fraud on March 15, 2006, he tried to<br />
rescind his guilty plea, and failing that, tried to prove to the Court with<br />
fuzzy math that he had in fact paid everyone back.<br />
<br />
When he went to prison shortly after sentencing, having been directed by the<br />
Court to cease his real estate activities, and having agreed to the Terms of<br />
Probation, what did he do? He wrote and e-mailed his "investors" and<br />
"partners" from his jail cell, telling them that he would be out soon, and<br />
would be back to continue doing business.<br />
<br />
When he was released from prison on July 3, 2008, he agreed to the<br />
Conditions of Release, which included the stipulation that he not be<br />
involved in any personal or business transactions without the approval of<br />
his parole officer, what did he do? He ignored the conditions of release<br />
and contacted those same Florida investors and partners in an effort to<br />
maintain his involvement and control over several real estate transactions.<br />
<br />
One of the Conditions of Release was that he refrain from any alcohol. With<br />
two alcohol related arrests last year, it is clear that he has not been able<br />
to control himself, and one wonders how many times he was drinking heavily<br />
in order to be caught and arrested twice in a six month period. The next<br />
thing we know, Mr. Coghill will be in court facing a vehicular manslaughter<br />
charge.... because he has not gotten the message.... and some poor family<br />
will be destroyed because of him.<br />
<br />
This is a man who has not learned his lesson. This is a man who thumbs his<br />
nose at the Court and does as he pleases. This is a man who has not one bit<br />
of remorse for the hundreds of victims he has injured over the course of 19<br />
years. This is a man who has not gotten the message that incarceration and<br />
punishment are meant to deliver. This is a man who cannot control his<br />
actions, who continues to operate above the law, and who will, given the<br />
chance, hurt others in the future.<br />
<br />
It should be clear to the Court that he will say or do anything to deflect<br />
blame for his actions, that he has failed to heed the many warning of the<br />
Court, and that he will, if not incarcerated, continue down the same path.<br />
<br />
The Court has an opportunity today to let Mr. Coghill know that he cannot<br />
continue to violate his Conditions of Release, that he cannot continue to<br />
involve himself in prohibited activities, that he cannot lie to the Court<br />
with impunity and do as he pleases. If 30 months did nothing to affect<br />
Mr.Coghill's actions, then I would hope that the Court consider sending him<br />
to prison for 60 months to see if that might have a more rehabilitative<br />
effect.<br />
<br />
I and the many victims that litter the Virginia landscape ask the Court to<br />
impose a sentence severe enough to end this arrogance, and a probation<br />
period long enough to ensure that Mr. Coghill is closely supervised for<br />
many, many years after release.<br />
<br />
Please lock him up, and keep him there."<br />
<br />
After my statement, Judge Moon said that could understand the disgust the victims in this case have with the system. It has failed them.<br />
<br />
The Judge then began to summarize the case and his reasoning for his judgment, when, not being able to remain quiet any longer, Nancy and Tom Sr. raised their hands and asked to be heard. Nancy was sworn in at the request of Prosecutor Hogeboom, and testified that our boy was needed at home to keep the fledgling bicycle attachment business going, and that while returns to date have been slight, there was much promise of money to be earned with the new business, with which the Court Ordered Restitution of Melcher and the Gordon's would be made. (yeah, sure).<br />
<br />
Tom Sr. was then sworn in, and began going down the same road, telling the Court that there were big sales of bicycle equipment on the horizon, and "all we want to do is have a chance to pay back the restitution to Mr. Melcher and the other victim". He then started to tell the Court about a real estate deal in Florida called the Conch House Marina in which Riverfront Development LLC held a 30% interest, and that he had spent 20 thousand dollars in legal fees trying to maintain the 30% position and that those monies could also be used for restitution. He said that the Conch House owners, the Ponce family, had taken 9 million dollars from the development funds, before putting it into bankruptcy, and that they (the Coghills) were dealing with some very bad people, dishonest people, down there.<br />
<br />
Mr. Hogeboom jumped from the prosecutors table and began peppering Coghill Sr. about the ownership of the trust that had an interest in the LLC, and the value of the assets. Senior said that the he was the trust manager and the JUNIOR was the beneficiary. Hogeboom wanted to know if these assets had ever been disclosed to the US Attorneys financial investigation office, and Senior said he did not know, but that they had no value. Hogeboom wanted to know why senior had spent $20 grand on an asset with no value? (at this point I looked over to the defense table, and Juniors attorney, John Edwards, is holding his face in his hands... and I just know he is thinking... shut up, you old fool, your just making things worse... ). This questioning of Coghill Senior about the Conch House went on for a while, with Senior finally offering to just take half his legal fees back, and the Government could take over his position in the property and use the money to pay back the victims.<br />
<br />
After Tom Sr. left the stand, Coghill was asked to stand, and asked if he had anything to say... and of course he did. He rambled on about how "remorsed" he was about the money that he stole from me and the Gordon's, that he would never again be involved in any real estate business, that he hoped to be able to build up the bicycle attachment business so that he could pay back the victims. He also asked if he could self report in a few days, so that he could go back to Virginia Beach and explain things to the EZ Beach employees.<br />
<br />
Judge Moon clearly had had enough of this circus and of Coghill, and told him so. He found no reason to follow the recommendation made by the Government that the sentence be at the low end of the scale, and instead told Coghill that he did not see that any remorse had been shown, that he had failed to fully disclose his assets to the Court at the March 15, 2006 sentencing, that evidence showed that he had continued to involve himself in real estate activities in violation of his conditions of release, and that he was therefor sentenced to 30 months in Federal Prison, with 3 years of supervised release to follow, starting today! HOORAY !!<br />
<br />
Coghill appeared shocked, and begged the Court to be allowed to go home for a few days. The Court refused, and the Judge exited the courtroom, just as an officer entered the defense area and took custody of a whimpering and shaking Coghill.<br />
<br />
PERFECT! WONDERFUL! GREAT FUN!<br />
<br />
I watched with relief and satisfaction as they had him remove his belt and personal effects and prepared him for jail.<br />
<br />
I was then approached by Nancy, who told me that she "prayed for me every night, and that my judgment was coming". (This, apparently is the Coghill mentality. How dare you persecute my poor boy for taking your half million dollars and leaving you on your ass. You are a very bad man.)<br />

Indicted again in 09, legal fees, motions, meetings, documents, another Pleas bargain, sentencing, more PRISON, newspaper stories, and websites. YOU made this choice.<br />

$702,000 in legal fees, hell, you could have paid me back and still be riding around sunny Florida in your fancy car, with 175K to the good, being a big shot. You could be there today, but you chose to go to prison.<br />

Smart? Your not smart. I remember playing poker with you. You did not know then<br />

Donald Melcher says he lost nearly everything after loaning Thomas E. Coghill Jr. money for his homebuilding business. The Charlottesville businessman claims he was out more than $527,000 after helping Coghill build houses in the Charlottesville area during the 1990s.<br />
<br />
To get financing from Melcher and others, Coghill claimed houses had been completed or were being built when in fact the sites were vacant lots or properties owned by others, according to a federal indictment.<br />
<br />
"I have no savings, no 401(k), no retirement money, as a result of losing virtually all my money to this liar, this psychopath, this fraud," Melcher testified in federal court.<br />
<br />
Coghill, who now lives in Virginia Beach, pleaded guilty to wire and bank fraud in connection with that case. In 2006, a federal judge sentenced him to 30 months in prison and ordered him to pay more than $3 million in restitution to his victims, including Melcher.<br />
<br />
Coghill, 49, was told by the court to report any future business dealings to his probation officer.<br />
<br />
But he didn't.<br />
<br />
Now, nearly four years later, Coghill is scheduled to be sentenced again today in Lynchburg for obstruction of justice. Prosecutors say that from 2005 to 2009, Coghill involved himself in several Florida real estate development deals worth millions without disclosing them to his probation officer - and kept doing business even as he served time on the fraud charges.<br />
<br />
Coghill's multimillion-dollar business dealings date back at least a decade and stretch from Virginia to Florida.<br />
<br />
A surfing and biking enthusiast born and raised in Virginia Beach, Coghill graduated from Old Dominion University with a physics degree and followed his father into real estate. He spent some of his time in Florida, working on family business there. More recently, Coghill patented a beach bike and cart.<br />
<br />
The fraud outlined in the first federal case against Coghill dates back to the 1990s.<br />
<br />
Victims Michael and Rena Gordon first came into contact with Coghill after he placed an ad in a Washington newspaper, Michael Gordon testified at Coghill's 2006 sentencing.<br />
<br />
The couple ran Anchor Capital Corp. in Maryland and provided financing to Coghill beginning in 1995.<br />
<br />
"We have obviously made a very huge mistake in trusting him," Michael Gordon testified. "And we clearly were not up to this job of dealing with a crook and a con man."<br />
<br />
Coghill forged certificates of occupancy and government documents and provided fraudulent financial statements and surveys, Gordon testified.<br />
<br />
"At the time of discovery of the fraud, there were about 75 lots which we thought had houses on them, which was the only reason we lent the money we lent," he testified. "We lent $55- $60,000 on a house. It turned out it was just a $5,000 lot."<br />
<br />
In 2005, Coghill was indicted for faxing fraudulent investment documents to two of his lenders.<br />
<br />
They indicated the construction of houses were substantially complete, when they were actually vacant lots.<br />
<br />
Melcher said in a phone interview this week that a real estate agent they both knew introduced him to Coghill, who did not return two messages for comment left at his family's Beach Investment Research Corp. One of his attorneys, John Edwards of Roanoke, declined comment Thursday.<br />
<br />
Coghill asked Melcher to lend money to his homebuilding business in 1991, Melcher said.<br />
<br />
He initially provided the financing to build only one house: $40,000, he said.<br />
<br />
But after Coghill kept paying him back the full amount, Melcher kept investing in more houses, he said. Coghill also financed his business by borrowing from a Richmond bank.<br />
<br />
After a few years, he invested to the point where he wasn't taking his principal back, just moving it from project to project, Melcher said.<br />
<br />
"Things went sweetly for eight years," he said.<br />
<br />
Coghill stayed in Charlottesville and had offices there, though he sometimes commuted from Virginia Beach, Melcher said.<br />
<br />
The last two years Melcher was involved with Coghill, in 1998 and 1999, they generally had about eight to 10 houses under construction at any time.<br />
<br />
And Coghill was paying him $10,000 a month in interest, Melcher said. He received checks from several different entities associated with Coghill's homebuilding business, he said.<br />
<br />
Then in late 1999, the payments stopped, Melcher said. He was out more than $527,000, he said.<br />
<br />
Melcher testified at Coghill's sentencing in 2006 that as a result of his dealings with Coghill, was living on less than $30,000 a year, had no credit, and had to struggle to send his daughters to college.<br />
<br />
Coghill's father, Thomas E. Coghill Sr., a real estate developer, testified at his son's sentencing that he told him he committed fraud and was sorry for it.<br />
<br />
"He never really intended to defraud anybody out of anything," Coghill Sr. testified. "But he was using the fraud that he was committing, which he did commit, to keep the construction business going, so that he could hopefully build his way out of it.<br />

"But that was not going to happen."<br />

Coghill Jr. admitted during his sentencing that he was a terrible bookkeeper and "was trying to run a 60-house-a-year business in my head." He and his father also blamed an alcohol problem, for which they said he received treatment.<br />
<br />
" When I was borrowing money from you all, I had a drinking problem," Coghill testified. "It wasn't as bad as it got later. And I kept thinking that just hard work was going to pay you all back. But it wasn't, because there wasn't enough - enough profit in the houses that I was building."<br />
<br />
Coghill's then-attorney, Curtis Fallgatter, said his client was impaired by both alcohol and severe financial constraints from the high interest rates in the deals he made.<br />
<br />
Coghill was ordered to pay the Gordons more than $2.8 million and Melcher $170,000 in restitution. Melcher said he's seen about $200 so far.<br />
<br />
Coghill served his sentence on the fraud convictions and was released from federal custody in July 2008. Prosecutors say he wasn't idle while in prison. In March 2009, a federal grand jury indicted Coghill on charges of obstruction of justice and perjury.<br />
<br />
Coghill understated the value of his business interests in Florida and got involved in real estate deals unrelated to his family's business without informing his probation officer as required by the court, according to the indictment.<br />
<br />
In a letter, Coghill sought a return on one of those investments:<br />
<br />
"You probably don't know who I am but I am the one that originally put together the purchase of the Conch House property, which we own...I will be out in July of this year and will file suits against the managing members if things are not resolved...All I want is my money back plus attorney fees and some of the money that the managing partners have taken...I have $395,000 in this property."<br />

Last year I contacted the Virginian-Pilot to see if they had any interest in doing a story on Coghill, who lives in Virginia Beach, an area served by this, the states 2nd largest newspaper. I spent a good deal of time faxing documents and answering questions with one of the reporters, but after several weeks of no communication, I lost contact with the paper and assumed they were no longer interested. I had forgotten about it until I was contacted last month by Jen McCaffery, who had picked up the file and wanted to get an update on the story. The fact that this is being published on the same day Coghill is scheduled to be sentenced makes it that much more enjoyable. I think Jen McCaffery did a very nice job of summarizing a long saga, and capturing the recalcitrant Coghill. Perhaps there will be a follow up after sentencing.<br />

Is it possible there are criminal acts by others that Coghill is willing to reveal in order to lessen his own sentence? Or is this more shucking and jiving by our boy in order to save his own skin? Heaven forbid! I must be dreaming. CTC would certainly support a 30 day delay if it meant that other thieves would be brought down with Junior... so we will just have to wait to see if there is any substance to this motion, and whether the Government and Judge Moon agree to a postponement. Seems like more of the Coghill "rope-a-dope" to CTC... but if there is an ongoing investigation into the "Conch House" deal, or any others that Coghill was involved in during his time in Florida, then it is surely going to get interesting. Will Coghill's information prove to be valuable enough to the Government to earn him a gold star from the US Attorney, and a pass on the prison time he faces? We hope not. In documents filed by the Government today, Assistant US Attorney Pat Hogeboom supported a short continuance for our boy's trial, but cited 3 areas of concern:<br />

1) A potential conflict of interest for John Edwards, who previously represented Coghill Sr., a government witness. Hogeboom writes "Since Mr. Edwards previously represented Coghill Sr. during the investigative stage of this matter, he would undoubtedly have obtained information that might prove critical in impeaching Coghill Sr.'s credibility." CTC thinks this issue could be the basis for an appeal, and the US is being proactive in pointing out the conflict. We are also surprised to see that Coghill Sr. is being tapped as a government witness. Does that mean they expect Sr. to testify against Jr.? Hmmmmmmm....... this should be interesting.<br />

2) As I wrote to Judge Moon and to Mr. Hogeboom in my letters to each, the second point raised by the US is Junior's ability to pay for John Edwards as co-counsel. Hogeboom writes "This is a surprising admission given the fact that Coghill Jr.'s current attorney was appointed by the Court based upon a finding by the Court that Coghill Jr. did not have the financial ability to hire his own attorney." Hogeboom then requests an inquiry into the source of funds to determine whether the defendant should be required to reimburse funds dispersed for his Court appointed attorney.<br />
<br />
We all know what's going on here... it's more of the Coghill shuffle (a subset of the rope-a-dope)... he turns his pockets inside out before the Court and pleads poverty, then at the eleventh hour dishes out big bucks for Edwards. In a footnote, the US points out that the current charges relate to "HIS ALLEGED FAILURE TO FULLY DISCLOSE HIS FINANCIAL STATUS" prior to sentencing, and that the US has not been advised of any change in Coghill's financial status that would allow him to personally retain counsel or INCREASE HIS RESTITUTION PAYMENTS. So, he can pay Edwards, but Anchor Capital and my family get to split $200 a month from his "salary." And if the funds are a loan or a gift to Jr. does that mean that the US has some say as to how those funds are dispersed? It warms the heart to see the US finally getting a handle on what most of us already know.... that Coghill is a sociopath and a liar who's every statement requires independent verification.<br />
<br />
3) Hogeboom also points out that the attorney for Riverfront Development Revocable Trust has filed a notice with the Bankruptcy Court of his intention to take the deposition of persons associated with Conch House Builders, LLC. which, in the US attorney's opinion, is "an entity used by Coghill Jr. to conceal ownership of assets." Hogeboom requests the opportunity to "prevent a civil proceeding being used to obtain discovery, harass witnesses or otherwise hinder the prosecution of the criminal matter."<br />
<br />
CTC thinks that Mr. Hogeboom has made some salient and thought provoking points, and we hope that Judge Moon will allow a hearing on the 13th to resolve the issues raised. A short continuance will probably be granted, a hearing held, and a new trial date set. For us, the prospect of waiting a few more weeks while Junior shucks and jives and pisses away somebody else's money (Mommy and Daddy's? A previously fleeced victim's?) certainly is interesting to watch, as the US noose gets tighter and tighter. Hopefully all of his scheming will lead to many sleepless hours for our boy, as he tries to unpaint himself from the corner he has painted himself into. We doubt there will be any outcome short of a year or two in the slammer, so the dance just provides more opportunity to watch him squirm. We hope he thinks about going back to prison every day, and that his misery leads to more misery.<br />

There will be a trial. He will be convicted. He will go back to jail where he belongs. We have known all along that junior would drag this out until he hired a real attorney to represent him at trial, and thus the need for a continuance and a chance to delay the inevitable, another spin in the pen. The Conditions of Release clearly state that Coghill is not to violate any federal, state or local law, and that he is to refrain from the use of any alcohol. I would guess that this is the tip of the iceberg, and that Junior is violating these conditions more often than he has been caught. Maybe this letter will get the Judge's attention and they will lock him up again.<br />

Well, we had a sweet day in court today with Junior. I arrived early to try to catch a photo of The Swindler entering the courthouse, but as usual, he had ducked in the back door. I caught up with him in the lobby, where he had just met his court-appointed public defender. I yelled out to him.. "Tommy, we're having fun now, aren't we?" he would not look at me, just kept his head down as he and the attorney rushed by, so I yelled... " Gottcha good this time, huh buddy? Whooo hoo hoo hooooooo" No…

He and the PD got on the elevator and went up to the third floor where they met up with Mommy and Daddy, and all huddled for a little while, then went into the courtroom. I followed, and went over and sat down right next to Mommy..... (oh my god, that awful Melcher man) she sniffed her dissatisfaction, and turned away. As I watched them huddle and whisper some more, all three got up and went across the aisle and sat down on the other side of the courtroom. Guess I (that nasty ole' victim) was too close for comfort.<br />

When Judge Moon came in, T-boy went inside the railing and took his place at the defense table, and was sworn in... yeah, like that means anything.... but he was full of "yes sirs" and "no sirs", very contrite... Then the fun started. Pat Hogeboom, the US Attorney, was asked by Judge Moon to read the indictments, which he did, and, of course, our boy says "not guilty". The judge then asked the US what they recommended for terms of release, and Hogeboom starts to rail against our poor boy, telling the Judge that he has violated the terms of his probation by doing business as an LLC, and wants $10,000 bond and close supervision. The PD then askes the Judge if Tommy can travel out of state to sell "beach attachments", and Hogeboom got all worked up, telling the Judge that our boy has been involved in business activities prohibited by the terms of his probation (which he then reads to the court, claiming that Tommy-boy had not informed his PO of said activities), and that he had conducted business from his jail cell, and that he had been cited for "Public Intoxication" in February (hearing scheduled for April 27th in Virginia Beach) and that the US Attorneys are sick of his violating probation, and sick of receiving letters "from United States Senators" complaining on behalf of victims (that would be me). I'm telling you, it was a moment of PURE JOY. So after a little back and forth about this LLC (EZBeachAttachments) that Jr. is involved with, the Judge says to our boy "you are digging yourself deeper and deeper", and you are not to travel out of the state or conduct any business without the approval of BOTH the parole officer and the US Attorney's office. Whoooopppeeeeee!! You go Judge.<br />

The trial date on these two indictments is set for June 15 through 18, I believe in Lynchburg. I understand that others are pursuing charges for Juniors misdeeds in Florida, so we might get really lucky and see more indictments in the near future. What a grand day!<br />

I had written several letters in the past (some posted as photos) to Senators, the FBI, to the Federal Prosecutors and to Federal Judges, asking them why Coghill had been allowed to return to Florida to continue scamming while under indictment, and why he had not been held accountable for lying to Judge Moon at his sentencing hearing, and why he was continuing to do business FROM PRISON! (I even spoke to his "Case Manager" at the prison in Arkansas) I believe that we were responsible for having him held for the full term of his sentence and not released in January of 08 as originally planned by the Feds, but I thought that my letters and pleas for justice had fallen on deaf ears. Apparently not!<br />

When another reporter called the next day and told me the details of the two new indictments, my comment was "SWEET". I had thought that this was connected to his scams in Florida, but it is nice to know that he still is answering for his crimes in Virginia, and STILL has alleged fraudulent activities to answer for in Florida.<br />

Coghill is scheduled to be arraigned in Federal Court in Lynchburg, in front of Judge Moon, on the 9th. I will be there to witness his next act of false contrition, and will be interested to see how Judge Moon handles this situation. I am very happy to have played some part in these indictments, or no part at all, as long as his ass is being dragged around by the Feds. With any luck, he will be tried and convicted of both of these crimes, and be back in the slammer for a long time.... and with any luck, he will be prosecuted for his scams in Florida, and be held in prison for a really long time!<br />
